SEC adds three crypto FAQ answers on when token governance counts as central control

• The Division of Corporation Finance added questions 1.4 to 1.6 to its crypto assets FAQ on November 2.

• Q1.4: unaffiliated token holders voting in governance are generally not treated as a group under the central party definition, even when governance runs through a foundation.

• Q1.5: lists unilateral powers that indicate control, such as changing code, choosing validators or reversing transactions.

• Q1.6: a system is functional when its token can be used for its programmed utility, and decentralized when no person or coordinated group holds operational, economic or voting control.

• The answers build on the SEC's March interpretation and are staff views without legal force.

XRP Ledger token minting fix nears Nov. 4 activation with 33 of 35 validators

Under the bug, accounts allowed only to destroy an issuer's tokens could create new ones in some conditions; XRP's own supply is unaffected. The amendment, fixCleanup3_4_0, can activate at about 14:46 UTC on November 4 if support holds, after a dip to 26 validators on October 21 restarted the two-week countdown. Activation needs 29 of 35 validators for two uninterrupted weeks. CoinDesk found no public reports that the flaw was exploited.
